Contract Regulations

Contract Regulations are the rules governing procurement & disposal of assets. They promote good purchasing practice and public accountability and deter corruption. Following the rules is the best defence against allegations that a purchase has been made incorrectly or fraudulently.

There is a legal requirement for all staff to comply with these regulations. Staff responsible for purchasing or disposal must comply with Contract Regulations. Contract Regulations lay down minimum requirements. A more thorough procedure may be appropriate for a particular contract.

For the purposes of these Regulations, where there is a requirement for communication to be in writing, this shall be deemed to include e-mail and fax transmissions as well as hard-copy.

All Relevant Contracts (see Contract Regulation 4) must be subject to competition (unless there is an exemption) as follows:

Contract Regulation Threshold Values

Value Procedure
Up to £5,000: One oral quote (confirmed in writing if > £500).
£5,000.01 - 30,000: Three written quotes to a purchaser specification.
£30,000.01 - 75,000: Formal Invitation to Tender, including specification (and normally the contract conditions) to at least four Candidates. Any pre-selected to be approved by Chair of Governing Body.
£75,000.01 - EU Threshold: Formal Invitation to Tender, as above, to 4 Candidates. Selection of Candidates after advertisement or from Approved Lists.
Above EU Threshold

EU Procedure.

Goods & Services - £139,893
Works - £3,493,313
